Virtual Developpement,
Co., EURL with a capital of € 1,000 registered to the RCS (Trade and Company
Register) of Montpellier under the number 494 626 237, headquartered at 76
allée des asphodèles, 34980 St Gely du Fesc, official website http://www.virtual-developpement.com,
offers several platforms of free games without purchase requirement and for an
indefinite period.
Virtual Developpement
(hereinafter the Company) requires any user of its game to read and acknowledge
the following Terms before registering.

§1: Paid Offers
§1.1 Overview
Most of
Virtual Developpement’s services are free. The user is not required to pay in
order to use these services. The paid offers or paid options are optional and
non mandatory. Any user may freely enjoy the free services that he receives, and
may purchase any additional services that he may be offered. You will not be
rebuked or admonished for having purchased or not a paid option.
Your registration does not require the purchase
of an option.
§1.2 Exceptions
Some
services offered by Virtual Developpement are entirely paid. The user is
however free to join them or not.
Registering for these services requires a
payment. Virtual Developpement will offer a period between the registration and
the payment. If the payment is not done at the end of this period, the company
may take any measure necessary: account lockout till payment or permanent
account deletion.
§2: Payment
§2.1 Payment type
The main payment of Virtual Developpement services is
Allopass. Some services may be paid by Credit Card through Paypal.
§2.2 Commitments
Payments are only one-time payments (see the rules of validity
of Allopass on www.allopass.fr, and
Paypal usage on www.paypal.fr). The
duration and condition of any extension depend on the type of offer that the
user has purchased. This information is displayed before the payment and varies
for each service and each purchase.
§2.3 Due date
The payment is deemed as done when the code is activated and
valid. The payment is received by the authorized provider. The renewed payments
are deemed as done at the due date (start of the activation period). You may
make the payments before the due date in order to avoid any service
interruption.
§2.4 Account not funded
If the account isn’t sufficiently funded, the user will
receive a failure to fund notification, whatever the payment type is. In case
of credit card rejection, the fee will be €40 per rejected payment unless the
user demonstrated that the bank fees are lesser. The user is suspended from the
game until he pays his debts.
The
payment notification is send to the registered email found in the user’s
profiles. It is the user’s duty to ensure that this address is valid and can
receive such notification.
§2.5 Debt collection
ViDev reserves the right to take any legally available means
to collect the unpaid sums. Additional fees may be added to the amount already
owed by the user.
§3: Payment Termination and Refund
§3.1 Payment termination
No payment shall be terminated. Once the payment is done, the
user may not request its termination.
§3.2 Refund
The
user may not request a refund once the payment is accepted. He is supposed to
have willingly accepted the paid option purchase and may not request the
termination of the service and its refund.
A
locked user who owns a valid paid option at the time of the lockout may not
request a refund: purchasing an option does not entitle to ignore the rules and
the penalties. It is up to the user to abide by the rules and accept their
consequences.
If a
major bug happens, or in case of any other issue related to the support and to
the services offered by Virtual Developpement, and if such bug or issues impede
the use of a paid option (e.g. loss of several days of option following a
server crash), the user may ask that the option be deferred.
An
option deferment means that an additional number of days, corresponding to the
number of lost days resulting from a bug, will be added to the normal duration
of the option.
The
deferment may be requested for at least a day. The person in charge of the
service (Game Master or Administrator) is the only person able to accept the
report, after having established that the bug qualifies as a major one. His decision
is a last resort decision.
§4: Data protection against Third Parties
Virtual Developpement may be aided by third parties for
payment recovery. The law acknowledges the right for these third parties to
access the personal data of users.
The data related to the recovery are the only
one communicated. For more information on data protection, please read the
Terms of Use.
§5: Responsibility, Terms modification and applicable laws
For
more information about the responsibilities of the user and the company, on the
modification of these terms and on the applicable laws, you may refer to the
Terms of Use: these terms apply to the Terms of Payment as well.
Playing without acknowledging these Terms is forbidden except for technical
reasons.
